General Terms and Conditions (GTC) for Photography Services

  1. General: The following General Terms and Conditions (GTC) apply to all contracts concluded between the photographer and the client. By placing an order, the client accepts the GTC. Deviating conditions of the client are only valid if the photographer .
  2. Conclusion of contract: A contract is concluded when the photographer confirms the client's booking request in writing. The photographer's offers are subject to change and non-binding.
  3. Scope of services::The scope of the services to be provided is set out in the written agreement between the photographer and the client. Changes or extensions to the scope of services require written confirmation by the photographer.
  4. Remuneration: The agreed remuneration is due after the service has been provided, unless otherwise agreed. Unless otherwise stated, the prices quoted are inclusive of statutory VAT. Costs for travel, accommodation and any expenses shall be invoiced separately, unless they are already included in the offer.
  5. Rights of use: The client shall receive the agreed rights of use to the photographs upon full payment of the remuneration. Unless otherwise agreed, the rights of use shall be granted exclusively for the client's own use. Any commercial use, reproduction, distribution or publication requires the prior written consent of the photographer. The raw files (RAW) shall remain the property of the photographer and shall not be released to the client unless this has been expressly agreed.
  6. Copyright: The photographer remains the author of the photographs in all cases. A sale or transfer of the copyright is excluded. The photographer is entitled to use the photographs taken for his own purposes, in particular for self-promotion and for presentation on his own website, social media or in photo competitions, unless the client expressly objects.
  7. Liability:  The photographer shall only be liable for damages caused by intentional or grossly negligent breach of duty. Liability for slight negligence is excluded. In the event of loss of or damage to the photographs, the photographer shall only be liable up to the amount of the agreed fee. The photographer accepts no liability for damage caused by third parties..
  8. Withdrawal and cancellation: The client may cancel the contract free of charge up to 14 days before the agreed photo shoot. Cancellation within 14 days before the date shall incur a cancellation fee of 50% of the agreed fee. If the photographer is unable to carry out the order due to illness, accident or force majeure, he shall endeavor to find a replacement photographer. In this case, there is no entitlement to compensation.
  9. Data protection: The photographer processes personal data of the client exclusively for the fulfillment of the contract and in compliance with the applicable data protection laws. The client agrees to the storage and processing of his data insofar as this is necessary for the provision of the contractually agreed services.
  10. Final provisions: The law of Greece shall apply. Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The place of fulfillment and jurisdiction is the photographer's place of business.
